Terms of Service

1. Who we are and what these terms cover

These Terms of Service (“Terms”) apply to your use of the NextLook web app and service (“NextLook”), provided by Vaydena – Softwarelösungen, Karl-Heinz Bicker, Biberstraße 27, 85354 Freising, Germany (“we,” “us”). By creating an account or using NextLook you agree to these Terms. If you do not agree, please do not use NextLook.

2. The service

NextLook uses artificial intelligence to turn a photo you upload into design suggestions for interiors (with NextLook Business also commercial spaces such as restaurants, hotels, retail spaces, salons, car dealerships, event venues, real estate listings and vacation rentals, vehicle photos for vehicle ads, and color and wrap previews for vehicles), exteriors, yards, patios and balconies. This includes redesigning in a chosen style, furnishing empty rooms, decluttering, renovating, editing selected areas marked with the brush, and borrowing a style from a reference photo. You can keep editing results, compare them with your original photo and download them.

With voice commands you say or type what should change. An AI language model turns that into a plan of individual image steps, answers questions about your photo in conversation mode and suggests ideas. An image is created only after you confirm the plan. Each image step counts as a regular design and is deducted from your daily allowance or your credits like any other design (sections 4 to 6). Failed steps are treated like failed designs, and the plan pauses after a failed step. If you do not confirm a plan or you stop it, steps that have not started are not counted. A step that has already started will be completed and counts as a design. The number of voice requests per day is limited, and you are not entitled to a particular number.

NextLook is available free of charge (section 4), as NextLook Plus for personal use (section 5) and as NextLook Business with commercial usage rights (section 6).

NextLook is an independent brand and is not affiliated with other providers of apps or services for room and interior design.

3. Your account

You need an account to use NextLook. If we have switched on guest access (“Free without signing up”), you can try the free tier without registering; an anonymous guest account without an email address is created automatically. Guest access covers the free tier only; Plus, Business and payments require your own account. These Terms also apply to guest access. You agree to give accurate information and to keep your password secret. Each person may have only one account. You must be at least 18 years old to use NextLook. The agreement for free use is formed when you complete registration. NextLook is offered to consumers and businesses alike.

4. Free use

With a free account you can create 3 designs per calendar day. Free designs are created at 1K resolution and with a watermark. If a design fails for technical reasons, it is credited back to your daily allowance. We may add bonus free designs. Editing selected areas with the brush, marking objects in Command mode and voice commands are not part of free use, including guest access; they come with NextLook Plus (section 5) or NextLook Business (section 6).

Free use is voluntary on our part. To prevent abuse or limit costs, we may temporarily limit or pause it, for example when an unusually large number of designs is requested on one day. You are not entitled to a particular number of free designs.

5. NextLook Plus

NextLook Plus is available for 30 days or 365 days, paid in advance. The price shown to you before you buy applies. If the price changes, it applies only to later purchases; periods you have already paid for are not affected. For the period you buy, Plus gives you designs at 1K resolution without a watermark, plus the brush for selected areas, object marking and voice commands. Plus is intended for personal use (section 9); for commercial use there is NextLook Business (section 6).

Each Plus purchase includes a fixed credit of designs. The credit shown to you before you buy applies; changes apply only to later purchases. You can always see in your account how many designs you have left and when they expire. Failed designs are not counted. Unused designs expire when the purchased period ends; they are not refunded or paid out unless you renew in time (see below). The credit comfortably covers personal use and also protects against automated or mass use.

Plus is not a subscription. Access ends automatically when the paid period ends; you do not need to cancel, and nothing is charged automatically. You can renew Plus at any time in your account by purchasing and paying again (section 7). If you renew before it ends, the new period is added to the remaining time, your remaining credit is kept and the credit from the new purchase is added; everything together is valid until the new end date. If you renew only after it has ended, a new period begins with the credit from the new purchase.

6. NextLook Business

NextLook Business is for businesses and self-employed professionals, such as restaurants, hotels, vacation rentals, retail, beauty and hair salons, real estate agents, car dealers or event organizers. Business is available for 30 days or 365 days, paid in advance. The price shown to you before you buy applies; price changes apply only to later purchases.

Business includes everything in Plus. For the period you buy, you also get designs at 2K resolution without a watermark and the commercial usage rights under section 9 for all images you create during the Business period. These rights apply permanently, even after the period ends. Images you create before or after the Business period are not covered. You can see which designs were created with Business from the “Commercial use” label in the app.

Each Business purchase includes a fixed credit of designs. It forms a single pool with any Plus credit you have; Plus runs at least as long as Business. Switching from Plus to Business: If you buy Business while Plus is still running, Business starts immediately. The remaining Plus time is not lost; it is added after the end of Business, and Plus (personal use) then runs correspondingly longer. No refund or credit toward the price is given. Section 5 applies accordingly to credit, expiry, renewal and ending: unused designs expire when the period ends, and Business is not a subscription, ends automatically and is not charged automatically. Sections 7 and 8 apply to payment, activation and refunds.

Commercial spaces (restaurant, café, hotel, retail space, salon, beauty studio, waiting area, vacation rental, real estate, car dealership, vehicle ads, wrap & paint and event venue) are available only with Business. They cannot be used with a free account, bonus designs or Plus.

7. Payment and activation

Plans are paid in advance through PayPal, in US dollars. When you pay with the PayPal button in your account, Plus or Business is activated automatically for the chosen period as soon as PayPal confirms the payment as completed to us, and you receive a confirmation by email. If PayPal holds the payment for review, the plan is activated only after PayPal confirms it. Activation begins right after payment, and you agree that the digital service starts immediately.

Nothing is charged automatically, and we do not store your payment method. PayPal handles the payment under its own terms and privacy policy.

8. Refunds

Plans are digital services that start immediately after payment. Payments are therefore generally final and non-refundable once a plan is activated, and unused designs or unused time are not refunded, including when you delete your account early, except where applicable law requires otherwise. Failed designs are not counted against your credit. If you were charged by mistake or twice, or if a payment did not activate your plan, contact us at kontakt@vaydena.de and we will work with you to fix it. We may grant refunds at our discretion.

9. Your content and uploaded photos

Upload only photos you have the necessary rights to, such as your own photos or photos you have permission to use. Please photograph rooms without people where possible; if other people are recognizable, you need their consent. Photos and notes must not contain unlawful, harassing, sexual or violent content, and you may not upload photos of other people's homes without the residents' permission.

You understand that your photos and inputs are sent to an AI service provider to create the images; details are in the Privacy Policy. Do not upload photos with confidential content, such as documents, screens or ID cards.

You keep all rights in your photos. You grant us only the rights needed to store and process them for the service and to show you the results. We do not use your photos for advertising.

10. Rights to generated images

Free and Plus: You may use images you create for free or with Plus personally, for example to plan your home, to share with family and friends or in personal posts on social networks. Commercial use is not permitted, for example on a company website, in listing sheets, ads, advertising, menus or posts for a business.

Business: Images you create during a Business period you may also use commercially, for your own business and for clients whose spaces you market or design, for example on websites, in listing sheets, ads, advertising, menus, presentations and social networks. This applies permanently, even after the period ends. You may not sell or license the images as stand-alone products, for example through stock image libraries.

You must not remove or cover the watermark on free designs. The result of each wrap & paint design carries the label “Visualization – not actual condition,” which must not be removed or covered. Colors are approximations and not a binding color specification; please confirm the actual color against a sample. Whether AI-generated images are protected by copyright is not settled. We do not guarantee exclusivity, and similar images may be created for others.

11. Real estate and vehicle ads: disclosure

If you publish images, especially in ads for real estate or vehicles, clearly label them as AI-generated visualizations so that nobody mistakes them for the actual condition. You are solely responsible for disclosing digitally altered images and for complying with all laws, regulations and listing-service rules that apply to you. These include, for example, California Business and Professions Code requirements as amended by AB 723 for digitally altered images in real estate listings, and the rules of multiple listing services (MLS) and other listing platforms. You must make sure the property is accurately represented and that required disclosures are made.

For vehicle images, NextLook changes only the surroundings, lighting and loose dirt. Before publishing, check that the vehicle, its equipment and its condition (including damage and wear) are shown correctly. The actual condition of the vehicle governs your offer.

12. Acceptable use

Automated access, circumventing allowances (for example with multiple accounts) and any other abusive use are not permitted. You may not use NextLook to create unlawful, deceptive, defamatory or harmful content, or to violate anyone's rights. In case of serious or repeated violations we may delete content and suspend your access temporarily or permanently.

13. AI output disclaimer

AI output can be inaccurate, can differ from what you expect and can resemble other images. The images, answers, ideas and object lists NextLook produces are visualizations only. They are not architectural, engineering, legal, financial or other professional advice, and they are not a guarantee that a design is feasible, safe, code-compliant or affordable. You are responsible for your decisions based on them, such as purchases, renovations or contractor orders.

14. Storage and availability

Designs you created with Plus or Business stay in your account until you delete them or your account. Free designs (including bonus designs) are automatically deleted 14 days after creation unless you have an active Plus plan. While your Plus runs, they are kept as well. Details are in the Privacy Policy. NextLook is not an archive service: please download images that matter to you. We aim for high availability but do not promise uninterrupted service. Maintenance, technical faults, outages at the AI provider or events beyond our control can cause temporary limits.

15. Disclaimer of warranties

NextLook is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

16. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption, arising from your use of NextLook. Our total liability for any claim relating to NextLook is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for decisions you make based on AI images. Nothing in these Terms limits liability that cannot be limited by law, for example for intentional misconduct or for death or personal injury.

17. Termination

You can stop using NextLook at any time and delete your account in your account settings. Plus and Business end automatically at the end of the paid period; no cancellation is needed. We may suspend or terminate your access as described in section 12. Paid periods are not refunded when you delete your account early, except as set out in section 8 or required by law. Sections that by their nature should continue to apply, including the rights to images under section 10, the disclaimers and the limitation of liability, survive termination.

18. Disputes

If you have a problem, please contact us first at kontakt@vaydena.de so we can try to resolve it informally.

19. Changes to these Terms

We may change these Terms going forward, for example to reflect a change in law or in the features of the service, provided you are not unreasonably disadvantaged. We will inform you of material changes in a suitable way, for example by posting the new version here with a new effective date. Periods you have already paid for are not affected. If you keep using NextLook after a change takes effect, you accept the updated Terms.

20. General

If any provision of these Terms is found to be unenforceable, the remaining provisions stay in effect. Questions about these Terms: kontakt@vaydena.de.
